1. About these terms

These terms apply when you, as a consumer, buy goods from Gyros City Wholesalers F&B Ltd (company number 15801851, VAT number GB 478483732), trading as Gyros City Wholesalers, of 100 Tyburn Road, Erdington, Birmingham B24 8LA ("we", "us") through the shop in our app. They sit alongside your legal rights, which we never try to take away.

If you are buying for your business, our Terms of trade apply instead.

2. Information we give you before you order

On each product page and at checkout we show what you are buying, the price including VAT, the delivery method and delivery charge (or that it is free), and how long delivery is expected to take. Please check your basket and delivery details before you pay.

Who we are: Gyros City Wholesalers F&B Ltd (company number 15801851, VAT number GB 478483732), trading as Gyros City Wholesalers, of 100 Tyburn Road, Erdington, Birmingham B24 8LA. Contact: support@gyroscitywholesalers.co.uk, 0121 798 0545.

3. Prices and payment

All shop prices include VAT at the applicable rate. Delivery charges are shown before you pay and are added to the total. Payment is taken by card through our payment provider when you place your order; we never see or store your full card number.

If we notice a pricing mistake we may cancel the order before dispatch and refund you in full.

4. Placing an order

When you tap the button marked as placing an order with an obligation to pay, you are making an offer to buy. We confirm it with an order confirmation in the app and by email, and the contract is formed when we confirm it. If something is out of stock or we cannot deliver to you, we will tell you and refund anything you have paid.

Rewards points and promotional codes are applied at checkout. Points have no cash value, are earned on what you spend, can be spent at 100 points for £1 off (up to half of your basket), and are lost if you delete your account. One promotional code can be used per order and codes cannot be combined unless we say so. We may change the rewards scheme with reasonable notice and will honour points already earned.

5. Delivery and collection

You choose courier, local van delivery or collection at checkout, and, where offered, a delivery day and morning or afternoon slot. Delivery times are estimates. Goods stay at our risk until delivered to you (or collected) and become yours when we have been paid.

Chilled and frozen goods need to be put away promptly. If nobody is in, we will try to deliver again or arrange a new time with you.

6. Your right to cancel

You normally have 14 days to cancel a distance purchase, starting the day you receive the goods. That right does not apply to goods that can spoil or expire quickly (including chilled, fresh and frozen food), or to sealed food that is unsuitable for return once unsealed for health reasons.

Where the right applies, tell us you are cancelling (by email or phone, or the form in the app) within the 14 days, and return the goods within 14 days of telling us. We refund the price and the standard delivery charge within 14 days of getting the goods back, or proof you sent them. You pay the cost of returning goods unless they are faulty or not as described.

You can also cancel an order before we dispatch it by contacting us straight away.

7. Faulty or incorrect goods

Goods must be of satisfactory quality, fit for purpose, as described and last a reasonable time (Consumer Rights Act 2015). If something is faulty, damaged, past its date or not what you ordered, contact us as soon as you can, with a photo. For food, the time you have to reject goods is related to how long they are meant to last, so please tell us promptly.

We will replace the goods, or refund you, without charge, and refund within 14 days of agreeing it is our responsibility. If you notice a problem with something chilled or frozen after delivery, please keep it and tell us the same day.

8. Allergies and dietary needs

Allergen information is shown on the product label. If you have an allergy or intolerance, always read the label and contact us before ordering if you are unsure. See our Allergen information page.

9. If you are unhappy

Please contact us first and we will do our best to put things right (see our Complaints procedure). We aim to acknowledge within 5 working days and give you an outcome within 30 days.

We are not currently a member of an alternative dispute resolution (ADR) scheme. If we cannot settle a complaint you may use an approved ADR provider, and we will tell you whether we agree to take part. You can also take a claim to court. The online dispute resolution platform for EU purchases is no longer available for UK traders.

10. Other terms

We may update these terms; the version in force when you order applies to that order. Your personal information is used as set out in our Privacy notice.

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may bring a claim in your local courts, and the law of England and Wales does not remove protections that you have under the law where you live.
